The Uniform Sign Code of the City of South Hutchinson, Kansas, 2011 Edition, in book or pamphlet form, is hereby adopted and incorporated by reference as the Sign Code of the City of South Hutchinson, Kansas; for the control and regulation of signs in the city as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Uniform Sign Code, are hereby referred to, adopted and made a part hereof as if fully set out in this article. Such incorporation is authorized by K.S.A. 12-3009 through K.S.A. 12-3012 inclusive, and K.S.A. 12-3301 and K.S.A. 12-3302, all as amended. No fewer than three (3) copies of said Uniform Sign Code shall be marked or stamped “Official copy as incorporated by the Code of the City of South Hutchinson, Kansas”, with all sections or portions thereof intended to be omitted or changed clearly marked to show any such omission or change and to which shall be attached a copy of this article, and filed with the City Clerk to be open to inspection and to be available to the public at all reasonable business hours.

In case of any conflict between the provisions of this article and the building code pertaining to signs, incorporated by reference in Section 4-101 of the Code of the City of South Hutchinson, Kansas; the building code shall control.

Any person, firm or corporation who shall violate the terms of this article shall be guilty of a violation of this code and upon conviction thereof shall be punished as provide in Section 114.3 of the building code. Each and every day that such violation continues may constitute a separate offense. In addition, every person violating the provisions hereof shall be subject to proceedings to restrain and enjoin such continued violation.
