No person, firm or corporation shall engage in or work at any of the following trades in the City of South Hutchinson, Kansas without having applied for and received a license therefor issued by the City of South Hutchinson, Kansas.

Plumbing

Mechanical (includes Heating Ventilation, Air Conditioning and Refrigeration)

All applications for licenses shall be filed with the City Clerk on forms provided by the City and shall accompanied with a fee as follows:

(a)   Master                                   $50.00

(b)   Journeyman                           $25.00

(c)   Apprentice                             $10.00

(d)   Existing Licensees                  $50.00

All licenses issued herein shall expire one year from the date of issuance.

All applications for licenses herein shall be accompanied by a Certificate showing the applicant has in effect a public liability insurance policy in the minimum amount of $100,000.00.

(a)   The building official shall have complete discretion to determine the qualifications of applicants for the licenses established and required herein. All applicants for initial Master or Journeyman licenses shall provide to the City a Certificate evidencing that a Master or Journeyman license has been issued to said applicant by Block and Associates or some other similar accredited testing organization.

(b)   Exception: Any person, firm or corporation, who is presently licensed and whose existing license is in good standing at the time Ordinance No. 06-731 is adopted (March 7, 2006), shall be exempt from the requirement of providing said Master or Journeyman Certificate when applying for an initial license under the provisions hereof or when applying for the renewal of said license. All such existing licensees shall pay the fee as prescribed in Section 4-1402 herein.

No apprentice license shall be issued to any person, firm, or corporation unless the applicant thereof is in the employ of or working under the direct supervision of a Master licensee in the City. Proof of such employment shall accompany all such applications.

All utility companies or their employees, doing business under the auspices of a franchise agreement with the City of South Hutchinson, Kansas shall be exempt from licensing requirements when engaged in the performance of its duties, obligations or rights conferred upon such utility by the franchise.

(a)   Except as stated hereafter, any owner of a single family dwelling or multiple family dwelling shall be exempt from the licensing requirements herein to construct, enlarge, alter, repair, improved, convert or otherwise perform any work on the electrical, plumbing, heating, air conditioning and structured contained therein.

(b)   Exception: It shall be unlawful for any property owner to tap the City’s main sewer line. All such taps shall be performed by a duly licensed plumber authorized under the auspices of a separate permit. Further, it shall be unlawful for any homeowner to install any Electrical Service Entrance, consisting of the electrical panel, main breaker, meter enclosure, riser and weather head or underground conduit on a pad mount transformer. Such Electrical Service Entrance shall be installed by a duly licensed electrician authorized under the auspices of a separate permit.

(c)   It shall be unlawful for anyone who is not an employee of the City Water Department to tap any City Potable water line.

(d)   Notwithstanding any licensing exemptions as stated in subsection (a) herein, no property owner shall be exempt from any and all permit requirements of the City and shall comply with all Codes and Ordinances of the City pertaining to such work.

(a)   The Public Officer for the City shall have the authority to suspend any license for the following reasons:

(1)   Failure to obtain a permit;

(2)   Creating a hazardous situation which endangers life and/or property;

(3)   Failure to correct a violation within the allotted time.

(b)   The Public Officer for the City shall have the authority to revoke any license for the following reasons:

(1)   Allowing a license to be used by another person, company or entity;

(2)   Creating a hazardous situation which endangers life and/or property;

(3)   Multiple violations of failing to obtain a permit, of creating a hazardous situation which endangers life and/or property, or of failure to correct a violation within the allotted time.

(c)   Procedure: The Public Officer shall mail or deliver written notice to the license holder setting forth the alleged violation(s) and stating a time and place at which the matter of suspension or revocation will be heard by the Public Officer. The license holder may appear with or without counsel. After hearing the matter, the Public Officer shall make written findings and specify the length of suspension, if any. During the course of suspension, all work shall cease, except that work necessary to correct a hazardous situation shall be performed under the supervision and direction of the Public Officer. In any case where a license holder is found to have committed any of the violation(s) listed in this section, the license holder may be suspended for a minimum of two weeks, and a maximum of one year. All suspended licenses shall be automatically reinstated after any suspension period for the balance of the licensed time, if any.

(d)   Any licensee whose license has been revoked by the City, shall upon future application for license, comply with all licensing requirements, the same as though no license had ever theretofore been issued to said applicant, including the requirements stated in Sections 4-1404 and 4-1405 a herein.

All licenses issued hereunder or proof thereof: shall be carried by the licensee at all times while working in the City and said licensee shall, upon request, exhibit same to the Public Officer or his or her representatives or to any officer of the City.
