The 2012 Edition of the International Property Maintenance Code is hereby adopted and incorporated by reference as the Property Maintenance Code of the City of South Hutchinson, Kansas; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions, and terms of the said International Property Maintenance Code are hereby referred to, adopted and made a part hereof as if fully set out in this article, with the additions, amendments, insertions, deletions and changes, if any, prescribed in this article. Such an incorporation is authorized by K.S.A. 12-3009 through 12-3012 inclusive, and K.S.A. 12- 3301 and K.S.A. 12-3302, all as amended. No fewer than three (3) copies of said International Property Maintenance Code, 2012 Edition, shall be marked or stamped “Official Copy as incorporated by the Code of the City of South Hutchinson, Kansas,” and all sections or portions thereof intended to be omitted or changed, clearly marked to show any such omission or change and to which shall be attached a copy of this article or the adopting ordinance and filed with the City Clerk to be open for inspection and to be available to the public at all reasonable business hours.

That the following sections of the International Property Maintenance Code 2012 Edition, are hereby amended as follows:

Section 101.1. Insert the City of South Hutchinson, Kansas in section 101.1.

Section 103.5. Insert: The fee schedule contained in the International Building Code, 2012 Edition, shall apply to the International Property Maintenance Code, 2012 Edition.

Section 112.4. Insert $25.00 and $100.00.

Section 302.4 is amended to read: All premises and exterior property shall be maintained free from weeds or plant growth in excess of 12 inches. All noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens. Upon failure of the property owner or occupant to comply with the notice of violation and any duly authorized employee of the jurisdiction or contractor hired by the jurisdiction shall be authorized to enter upon the property in violation and cut and destroy the weeds growing thereon. The costs of such removal shall be paid by the owner or agent responsible for the property. There shall be a minimum hourly fee of $60.00 per hour for a minimum of one hour and a $100.00 administrative fee for each time the weeds and grass are cut or mowed by the City or its contractor. Upon failure of the property owner to timely pay said amounts, the same may be collected by whatever legal means are available to the City including certifying the amount to the City Clerk and having the bill placed on the tax roll under real estate taxes for the subject property.
