CHARTER ORDINANCE AMENDING CHARTER ORDINANCE NO. 1 PROVIDING FOR THE ELECTION OF SIX COUNCILMEN, SELECTION OF MAYOR, THEIR TERMS OF OFFICE.

SECTION 1. Charter Ordinance No. 1 passed by the governing body of the City of South Hutchinson, Kansas on November 17, 1964, is hereby amended as follows:

A.        Section 1 of said charter ordinance is amended by the addition of the following phrase: “Said city further exempts itself from and makes inapplicable to it K.S.A. 15-201, 1973 Supp. which applies only to mayor-council cities of the third class, and elects to and hereby does provide substitute and additional provisions as hereinafter set out.”

B.         Section 2 is amended by deleting the phrase “At that time, and each two years thereafter, the police judge shall be elected for a two year term, and until his successor is elected and qualified.”

C.         Section 3 of said ordinance shall be deleted and amended to read as follows: “No person shall be a candidate for, or elected specifically, to the office of mayor. At the first regularly scheduled meeting of the city council of South Hutchinson, Kansas, following the election of 1975, and at the first regularly scheduled meeting in May of each year thereafter, the members of the council, so constituted, shall elect one of their members as mayor of said city. Said person shall hold the office of mayor for the term of one year and until his successor shall be elected and qualified. A member of the council may serve successive terms as mayor if so elected.

After completion of his term as mayor, if not re-elected to that office, or otherwise not qualifying, such person shall begin his term as councilman, and serve in that capacity for the remainder of his unexpired term, if any, and until his successor is elected and qualified. Whenever a tie shall occur, in the vote for any person for mayor, said tie shall be resolved in favor of that councilman who received the largest number of votes in the last election in which he ran for office.
